Ykone SAS takes care, when processing your personal data, to comply with the applicable regulations, including the Data Protection Act of January 6, 1978 amended by Law No. 2004-801 of August 6, 2004 and European Regulation No. 2016/679/ EU of April 26, 2016 (GDPR).

The purpose of this Policy is to inform you of the methods of processing personal data concerning you and the rights you have. We invite you to read it regularly. Any substantial modification will be notified to you.

ARTICLE 1. RESPONSIBLE FOR PROCESSING & CONTACT DETAILS

Campaygn is a platform that connects customers and influencers on social networks (“Campaygn”). Campaygn allows customers to find and track influencer activity. You can contact Ykone at the following address: data@ykone.com.

ARTICLE 2. PERSONAL DATA COLLECTED

2.1 Personal data that you have communicated to us in the context of our contractual relationship. Ykone collects your personal identification and connection data that you have communicated in order to be granted a Campaygn license, such as your first and last name, your email address, your telephone number or your connection details.

2.2 Personal data that you provide to us in order to exercise your rights

When you exercise your rights of access, rectification, erasure, restriction or opposition in accordance with Article 5 of this Privacy Policy, Ykone will collect your e-mail address, surname, first name and, where where applicable, proof of identity so that Ykone can verify your identity and respond appropriately to your request.

2.3 Personal data we collect on your behalf

Ykone may collect stories from certain influencers on your behalf if you request it. As such, you warrant that you have obtained the influencer’s consent in accordance with the GDPR.

ARTICLE 3. TERMS OF COLLECTION OF PERSONAL DATA

Ykone may collect your personal data in various ways, including:

● when you use and browse the website, for example by placing cookies on your
device.
● during exchanges via the contact and information collection forms on the website, by email, by post, by telephone or on social networks.
● when you register and use the features of the Campaygn account. Personal data about you may be collected directly by your declaration or automatically by Ykone’s systems.

ARTICLE 4. NECESSITY OF COLLECTION AND MANDATORY INFORMATION

Providing certain information is mandatory to allow Ykone to respond to your request and allow you to benefit from certain specific features. If you do not provide this information, Ykone may be unable to provide you with certain features or respond to your request. Fields that are not filled in as mandatory are left to your discretion.

ARTICLE 5. PURPOSES AND LEGAL BASIS OF THE PROCESSING

Ykone collects some of your personal data for the following purposes:

● the registration, subscription and provision of Campaygn available to Ykone
customers who have a license for Campaygn.
● the request for a demonstration period of the Campaygn solution.
● connection to the Campaygn solution.

● the management and operation of the website and the Campaygn solution.
● management of requests to exercise rights.
● management of the relationship with technical service providers.
The processing carried out by Ykone is based on the following elements:
● the performance of the contract (article 6.1(b) of Regulation 2016/679 of the
European Parliament and of the Council of 27 April 2016 on the protection of
personal data (GDPR).
● Your consent (article 6.1(a) of Regulation 2016/679 of the European
Parliament and of the Council of 27 April 2016 on the protection of personal
data (GDPR), for the deposit of certain cookies on your terminal.

ARTICLE 6. PERIODS OF STORAGE OF PERSONAL DATA

We keep your personal data only for the time necessary to achieve the purpose for which we collected it, in order to meet your needs or our legal obligations. Storage times vary depending on several factors, such as:

● The needs of Ykone’s business;
● Contractual requirements;
● Legal obligations;
● The recommendations of the supervisory authorities.
● Data relating to the management of your user account on Campaygn is only kept for the duration of the contractual relationship, and is destroyed at the end of the contract.

ARTICLE 7. RECIPIENTS OF YOUR PERSONAL DATA

Access to your personal data is strictly limited. Ykone may nevertheless be required to transmit your personal data to certain third-party recipients:

● Internally: to the personnel of the Ykone teams in charge of managing the Campaygn solution and the processing identified, subject to an obligation of confidentiality in the performance of their duties.

● Externally: Ykone may communicate your personal data to its technical service providers.
● To other third parties: if such communication is required by law, a regulatory provision or a judicial decision or to respond to possible complaints or protect the security of your personal data.

ARTICLE 8. TRANSFER OF YOUR PERSONAL DATA OUTSIDE THE EU

Ykone transfers data to third countries outside the European Union, through its service providers, staff and Customers.

If this third country has not been the subject of an adequate level of protection decision by the European Commission in accordance with Article 45 of the GDPR, Ykone and its client sign standard contractual clauses in accordance with Article 46 of the GDPR to cover the transfer of personal data.

ARTICLE 9. EXERCISE OF RIGHTS AND COMPLAINTS

In application of the applicable regulations, you have the following rights regarding the personal data concerning you:

● Right of access to know what personal data is processed by Ykone.
● Right of limitation if you want the processing of your personal data to be suspended.
● Right to erasure if you want Ykone to no longer process all or part of your personal data.
● Right to object if you want your personal data to no longer be processed by Ykone for reasons related to your particular situation.
● Right of portability if you wish to recover your personal data or have it recovered by a third party (receive in a structured, commonly used and machine-readable format the personal data collected as part of the Seller Form).
● Right to rectify (complete, update, block) your personal data that is inaccurate, incomplete, ambiguous, outdated or whose collection, use or communication or storage is prohibited.
● Right to define directives on the fate of your personal data after your death.

● Right to withdraw your consent at any time for the data you have submitted via the Recommendation Form.

In accordance with Article 12.5 of the GDPR, Ykone may refuse to comply with your request if it is clearly unfounded or excessive. You can exercise these rights by sending an email to data@ykone.com, indicating your first and last name.

You are informed that Ykone reproduces the information that you have made public on the Source Sites. In order to modify the information concerning you which is collected by Ykone from the Source Sites, you must correct it yourself directly on the social network concerned, Ykone cannot intervene on the latter.

In accordance with article 85 of law n°78-17 relating to data processing, files and freedoms of January 6, 1978 as amended by the Data Protection Act, you can define the directives relating to the storage, erasure or communication of your personal data after your death.

● If these are general directives concerning all of your personal data, they may
be recorded with a trusted digital third party certified by the National
Commission for Computing and Liberties (the “CNIL”).
● If these are directives specific to the personal data collected by Ykone, they
are registered with Ykone. You can change or revoke your guidelines at any
time.

When browsing the site https://app.campaygn.com/ cookies are deposited and/or read by Ykone on your terminal.
